These Terms of Service (“Terms”) govern your access to and use of the XploreNew website and our product suite — CRM System, Property Management System, Gatepass System, and AI Business Solutions — all delivered as web-based platforms.

1. Acceptance of Terms

By accessing or using the XploreNew website or any of our products (CRM System, Property Management System, Gatepass System, AI Business Solutions — collectively, the “Services”), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services. If you are using the Services on behalf of a company or organization (e.g. a real estate developer, gated community, or hospitality business), you represent that you have authority to bind that entity to these Terms.

2. Our Services

XploreNew Technologies Pvt. Ltd. provides a smart property automation platform for the Indian real estate, hospitality, and property management sector. Our product suite currently includes:

• CRM System — lead capture, pipeline management, and WhatsApp-native automation for real estate sales teams
• Property Management System (PMS) — bookings, maintenance, billing, and guest communication for apartments and resorts
• Gatepass System — digital visitor and vehicle entry management for gated communities
• AI Business Solutions — AI-powered lead scoring, predictive analytics, and automated workflows

We may add, modify, or discontinue features of any Service at our discretion, and will provide reasonable notice of material changes where practical.

3. Eligibility & Accounts

• You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account, including sub-accounts used by your team.
• You agree to provide accurate registration and business information and keep it up to date.
• Notify us immediately at info@xplorenew.com if you suspect unauthorized use of your account.

4. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable regulation
• Reverse-engineer, decompile, or attempt to extract source code from any product, except as permitted by law
• Introduce malware, attempt unauthorized access, or interfere with the Services’ operation or security
• Scrape, harvest, or misuse data (including customer/lead/visitor records) beyond your authorized use
• Use the WhatsApp automation features to send unsolicited or non-compliant messages in violation of WhatsApp’s own business policies
• Impersonate any person or entity, or misrepresent your affiliation

We reserve the right to suspend or terminate accounts that violate this section.

5. Intellectual Property

All software, designs, trademarks, logos, and content associated with XploreNew and its product suite are owned by XploreNew or its licensors and protected by applicable intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended business purpose. No other rights are granted. Customer, lead, and property data you input remains yours; see our Privacy Policy for how we handle it.

6. Fees, Subscriptions & Billing

• Access to CRM System, PMS, Gatepass System, and AI Business Solutions requires a paid subscription, priced in INR, as described on our Pricing page.
• Subscriptions renew automatically at the end of each billing cycle unless cancelled before renewal.
• Fees are refundable in full if you’re not satisfied within the first 30 days of a paid subscription, no questions asked — matching the policy on our Pricing page. Confirm this is the policy you want stated here before publishing.
• Free trials convert to a paid plan at the end of the trial period unless cancelled beforehand.
• We may change pricing with reasonable advance notice; continued use after a price change constitutes acceptance.

7. Onboarding & Support

Our team may assist with configuration, data import, WhatsApp integration, and training as part of onboarding. Support scope and response times for paid plans are described on our Pricing page and Book a Demo pages.

8. Third-Party Services & Integrations

The Services integrate with third-party tools (e.g. WhatsApp Business API, payment processors, Google Analytics). We do not control and are not responsible for third-party content, policies, or practices. Your use of any integrated third-party service is also subject to that provider’s own terms.

9. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or completely secure, though we target the uptime SLA described on our website.

10. Limitation of Liability

To the maximum extent permitted by law, XploreNew shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from your use of the Services. Our total aggregate liability for any claim shall not exceed the amount you paid to XploreNew in the 12 months preceding the claim — confirm this period is correct. Some jurisdictions do not allow certain liability limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless XploreNew, its officers, employees, and affiliates from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Services, your data, or your violation of these Terms.

12. Termination

You may cancel your subscription or delete your account at any time. We may suspend or terminate your access if you violate these Terms, pose a security risk, or as required by law. Upon termination, provisions that by their nature should survive (intellectual property, disclaimers, limitation of liability, indemnification) will remain in effect.

13. Governing Law & Disputes

These Terms are governed by the laws of India. Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Hyderabad, Telangana, India — matching your registered office address. Confirm this is the jurisdiction you want before publishing.

14. Changes to These Terms

We may revise these Terms from time to time. Material changes will be communicated via the website or email. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
